Welcome to Fernwood Real Estate Investment Group (“FREIG,” “we,” “our,” or “us”).
By accessing or using our website, software tools, investor materials, or professional services, you (“Client,” “Buyer,” or “User”) agree to the following Terms and Conditions of Service. Please read them carefully before proceeding.
1. Scope of Services
FREIG and its licensed agents provide real-estate advisory and brokerage services for clients seeking to purchase investment properties, primarily in the Las Vegas area. Our services may include:

Identifying, analyzing, and presenting potential investment properties.

Negotiating offers and coordinating transactions.

Providing proprietary analytical tools (“Investor Tool”) and related market data.

Coordinating third-party service providers such as inspectors, managers, and contractors.
We act as licensed Nevada real-estate professionals under Keller Williams VIP Realty. All services are subject to Nevada law and real-estate licensing regulations.
2. Buyer Representation Agreement
Engagement with FREIG constitutes an exclusive Buyer Brokerage Representation Agreement.

Term: The agreement begins upon execution and remains effective until the specified expiration date or completion of a property purchase, unless canceled by written notice by sending an email to Cleo@Fernwood.Team.

Exclusive Relationship: Buyer agrees to work exclusively with FREIG for any property FREIG selected, provided, and researched during the term of this agreement. If Buyer sources a property for which FREIG did not select, provide, or researched, FREIG has no claim for a commission, but Buyer will receive no services from FREIG.

Termination: Either party may terminate at any time by written notice via email (Cleo@Fernwood.Team) or certified mail (Eric Fernwood, 7345 S Durango Dr, #107-102, Las Vegas, NV 89113.) Termination is effective upon timestamp or postmark.
If Buyer purchases a property introduced by FREIG (via the Investor Tool, email, or other means) within 90 days after termination, Buyer agrees that FREIG was the procuring cause and will pay FREIG a 2.5 % fee of the gross purchase price, payable within 10 days of closing.
3. Fees and Compensation

FREIG’s standard fee is 2.5 % of the property’s gross purchase price, plus a $610 transaction fee paid buy the Buyer through escrow. Buyers have only contributed to our 2.5% commission on 6 to 8 properties out of more than 580 properties. And, if Seller is unwilling to pay FREIG’s commission, we recommend looking for a different property where the Seller will pay FREIG’s commission.

If the Seller does not pay the full amount, Buyer agrees to pay the difference at closing.

FREIG does not accept compensation from any other source.

If Buyer does not wish to pay FREIG’s fee, FREIG MAY refer Buyer to another agent to buy the specific property and FREIG will provide no further services.

Buyer is responsible for all attorney or collection costs associated with unpaid fees.
4. Confidentiality and Use of Information
All non-public information, proprietary data, and Investor Tool content provided by FREIG are confidential and remain the property of FREIG.
Buyer agrees not to share, reproduce, or use such information for personal or third-party benefit during or for one year following termination of services.
Upon termination, Buyer must delete and discontinue all use of proprietary data.
5. Multiple Clients and Fair Representation
FREIG may represent multiple clients interested in the same property.

All client data and offers are kept confidential.

FREIG will disclose the existence (but not terms) of competing offers.

Each client receives equal access to property information and fair representation.
All actions comply with the Nevada “Consent to Act” requirements for dual representation.
6. Third-Party Service Providers
FREIG partners with independent third-party providers for services such as inspections, renovations, and property management.

Each provider operates independently and bills the Buyer directly.

FREIG disclaims all liability for third-party performance, pricing, or outcomes.

Buyer is free to use alternative providers and assumes full responsibility for their selection and results.
7. Data and Market Information Disclaimer
Real-estate data (including listings, pricing, rent estimates, and projections) is derived in part from the Las Vegas REALTORS MLS Internet Data Exchange (IDX). This information is deemed reliable but not guaranteed.
No warranty is made regarding accuracy, completeness, or fitness for any purpose. Investment outcomes are subject to market fluctuations, interest-rate changes, and other variables.
8. Software License and Intellectual Property
Use of FREIG’s software, data, processes, and reports is provided “as is,” without any warranties, express or implied.
You may not copy, modify, sell, or reverse-engineer any part of our proprietary tools without prior written authorization.
You are granted a limited, non-exclusive, non-transferable license to use these tools for personal investment evaluation only.
9. Limitation of Liability
FREIG, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

Use or inability to use our services, tools, or information;

Delays, errors, or inaccuracies in data;

Acts or omissions of third-party vendors; or
-
Unauthorized access or technical failures.
Where law prohibits limitation of liability, FREIG’s liability shall not exceed the total amount of fees paid for the specific transaction giving rise to the claim.
10. Wire Transfer and Cyber-Fraud Warning
Real-estate transactions are frequent targets of cyber-fraud.
FREIG will never email wire-transfer instructions.
Always confirm transfer details directly with your escrow officer by telephone.
FREIG is not responsible for losses due to fraudulent or intercepted transfer instructions.
11. Equal Housing Opportunity
FREIG strictly adheres to federal, state, and local fair-housing laws.
We do not discriminate based on race, color, religion, sex, disability, familial status, national origin, or any other protected category.
12. Governing Law and Dispute Resolution
These Terms and all services provided are governed by the laws of the State of Nevada.
Any disputes shall be resolved exclusively in the county where the property is located.
If arbitration or collection is required, the prevailing party is entitled to reasonable attorney’s fees and costs.
13. Updates and Modifications
FREIG may update these Terms at any time without prior notice. Continued use of our website or services constitutes acceptance of any revised Terms.
