Policies, Fees, License and Disclaimer

Purpose of This Disclosure

Fernwood Real Estate Investment Group operates differently from traditional residential real estate agents. Using proprietary data-mining software, research, internal processes, and market analysis, Fernwood identifies and evaluates potential investment properties for its clients.

Because multiple clients may receive the same property information, there is a small possibility that more than one client may choose to submit an offer on the same property. This disclosure explains how Fernwood handles those situations, along with policies regarding third-party service providers, source data, software use, and investment-related disclosures.

Our Policy

Fernwood provides the same Investor Tool and property information to all active clients. There are no hidden or exclusive properties reserved for select investors.

Clients independently decide whether to pursue a property and whether to submit an offer. Fernwood does not direct or require clients to pursue any particular property.

All client conversations and investment discussions are treated confidentially. Fernwood does not disclose a client’s investment activity, conversations, or intentions to other clients or third parties.

On rare occasions, more than one Fernwood client may choose to submit an offer on the same property. In those situations:

  • Fernwood is legally and ethically required to present all offers.
  • Fernwood will not disclose the amount, structure, terms, or negotiating position of another client’s offer. If a client asks whether another Fernwood client has already submitted an offer on a property they are considering, Fernwood will answer yes or no. However, no additional details regarding the competing offer will be disclosed. Clients should also understand that competing offers may come from other real estate agents and their clients, not just Fernwood clients.
  • If a Fernwood client successfully purchases a property and another Fernwood client submitted an unsuccessful offer on the same property, Fernwood may disclose to the unsuccessful bidder that another Fernwood client was the successful buyer. However, Fernwood will not disclose the buyer’s identity, offer price, contract terms, or other confidential details. After closing, the final sale price may become publicly available through MLS records or other public sources.

 

Fernwood reserves the right to discontinue providing access to the Investor Tool, software, research, or services to any individual at any time and for any reason.

Third Parties

Real estate investing requires many different professional services, including property inspection, renovation, lending, insurance, escrow, and property management. Many of these services fall outside Fernwood’s direct business operations.

Fernwood may introduce clients to third-party service providers that Fernwood believes are experienced and reliable. However, all third-party providers operate as independent businesses and are solely responsible for their own services, pricing, scheduling, work quality, warranties, and deliverables.

Clients contract directly with and pay all third-party providers directly. Under no circumstances do client funds flow through Fernwood for third-party services.

Fernwood may assist with scheduling or coordination as a courtesy to clients. Fernwood does not charge for these coordination efforts and does not accept compensation for coordinating third-party services.

Fernwood receives no compensation, referral fees, kickbacks, commissions, or financial incentives of any kind from any third-party service provider.

Fernwood disclaims responsibility and liability for the actions, work quality, errors, omissions, delays, or performance of any third-party service provider.

You Are Free to Use Other Service Providers

Clients are not required to use any vendor, contractor, lender, inspector, property manager, or service provider recommended by Fernwood.

Clients are free to select any service providers they choose. Fernwood will make a reasonable effort to assist with coordination when possible, but clients remain fully responsible for selecting, supervising, and resolving issues with any service provider they choose to hire.

Data Disclaimer

Property information used by Fernwood may come from public records, third-party vendors, brokers, property managers, contractors, market participants, and the INTERNET DATA EXCHANGE (IDX) program of the Greater Las Vegas Association of REALTORS (GLVAR) MLS. GLVAR deems this information reliable but does not guarantee its accuracy.

Fernwood makes no representation or warranty regarding the accuracy, completeness, reliability, or usability of any information, projections, estimates, or analyses provided. Market conditions, rents, operating costs, financing terms, appreciation rates, and other investment factors may change without notice.

Clients are responsible for independently verifying all information before making investment decisions.

Software and Service License

By accessing or using Fernwood’s software, Investor Tool, research, analyses, processes, or services, you acknowledge and agree that all services are provided “as is” without warranties of any kind, whether express or implied.

Fernwood disclaims all warranties, including but not limited to:

  • Accuracy or completeness of information
  • Availability or uninterrupted access to services
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

 

Fernwood is not liable for any direct, indirect, incidental, consequential, or special damages arising from the use of, inability to use, or reliance upon any software, information, analysis, or services provided.

Clients acknowledge that Fernwood’s software, systems, and research processes contain proprietary and confidential information are protected by intellectual property laws.

Clients may not:

  • Copy
  • Modify
  • Reverse engineer
  • Distribute
  • Resell
  • Republish
  • Transfer
  • Create derivative works from any Fernwood software, research, systems, or materials without prior written permission.

 

Fernwood reserves the right to modify, suspend, revise, or discontinue any service, feature, software, or information at any time without prior notice.

Investment Risk Disclosure

All information provided by Fernwood is for informational purposes only. Nothing provided should be considered legal, tax, accounting, financial, or investment advice.

Real estate investing involves risk. Property values, rental income, operating expenses, financing conditions, interest rates, insurance costs, taxes, and market conditions may change over time. Past performance does not guarantee future results.

Clients are responsible for independently evaluating all properties, investment strategies, assumptions, projections, and risks before making any investment decision. Fernwood encourages all investors to consult qualified legal, tax, financial, and accounting professionals before purchasing investment property.

Any estimates, projections, forecasts, or opinions provided are based on assumptions that may not occur and should not be relied upon as guarantees of future performance.
